New Laws Effective July 1st!
On July 1, 2024, several new laws went into effect, relating to persons with disabilities. They are as follows:
HB 474
This law requires retail establishments that don’t offer public restrooms but have an employee restroom to allow any customer with an eligible medical condition to use the employee restroom during normal business hours. If this law is violated, the customer can take legal action, not to exceed $100.
HB 764
This law empowers tenants who are victims of family abuse, sexual abuse, or other criminal sexual assault to terminate their rental agreement if they have obtained a permanent protective order and give written notice of termination. Current law makes it much harder for victims to terminate rental agreements.
HB 908
This law requires amendments to the financial eligibility standards for those receiving the Family and Individual Support Waiver, Community Living Waiver, and Building Independence Waiver (the DD Waivers). These amendments will increase the number of people eligible to receive DD Waivers. The law also requires a report on how many Virginians could benefit from changes to the eligibility standards.
HB 909
This law requires state agencies to seek federal authority to update Home and Community Based Services Waivers to remove burdensome regulations on parental caregivers. This would ensure our most vulnerable Virginians living with disabilities get the support and resources they need.
HB 1040
This law states that any caregiver or person with a disability who is attending a meeting of a public body virtually must count towards quorum. The law also states that a public body cannot prohibit or restrict any member from casting a vote simply because they are attending remotely.

El 1 de julio de 2024, entraron en vigor varias leyes nuevas relacionadas con las personas con discapacidad. Son los siguientes:
HB 474
Esta ley requiere que los establecimientos minoristas que no ofrecen baños públicos pero que tienen un baño para empleados permitan que cualquier cliente con una condición médica elegible use el baño para empleados durante el horario comercial normal. Si se viola esta ley, el cliente puede emprender acciones legales, que no excedan los $100.
HB 764
Esta ley faculta a los inquilinos que son víctimas de abuso familiar, abuso sexual u otra agresión sexual criminal a rescindir su contrato de alquiler si han obtenido una orden de protección permanente y notifican la rescisión por escrito. La ley actual hace que sea mucho más difícil para las víctimas rescindir los contratos de alquiler.
HB 908
Esta ley requiere enmiendas a los estándares de elegibilidad financiera para quienes reciben la Exención de apoyo familiar e individual, la Exención de vida comunitaria y la Exención de construcción de independencia (las Exenciones DD). Estas enmiendas aumentarán la cantidad de personas elegibles para recibir exenciones DD. La ley también exige un informe sobre cuántos virginianos podrían beneficiarse de los cambios en los estándares de elegibilidad.
HB 909
Esta ley requiere que las agencias estatales busquen autoridad federal para actualizar las exenciones de servicios basados en el hogar y la comunidad para eliminar regulaciones onerosas para los padres cuidadores. Esto garantizaría que nuestros virginianos más vulnerables que viven con discapacidades obtengan el apoyo y los recursos que necesitan.
HB 1040
Esta ley establece que cualquier cuidador o persona con discapacidad que asista virtualmente a una reunión de un organismo público debe contar para el quórum. La ley también establece que un organismo público no puede prohibir o restringir a ningún miembro la posibilidad de votar simplemente porque asiste de forma remota.
